It is important to understand that after a case is formally dismissed, there’s nothing left to settle. Blanche announced the “anti-weaponization fund” to “settle” a case that had already been dismissed on his request. The court did not approve the ‘settlement,’ having never acceded to jurisdiction over the claim in the first place.

The $1.776 billion “resolution” was not authorized by any statute either. Blanche claims that 31 U.S.C. § 1304 authorizes it, but the Judgment Fund is statutorily limited to paying legal settlements and judgments against the United States, which this was not, because there 1. was no case in controversy, 2. no jurisdiction, 3. the complaint was dismissed with prejudice, 4. there was no judgment, and 5. no “settlement” was approved by any court.

The $1.8 billion fund is wholly untethered from the law or the ruse of a case Trump filed, and is, in reality, Blanche’s own legal invention to hold open the treasury cookie jar while Trump dug deep.

None of us could filch so much as a candy bar from the check-out line without being observed on camera and hauled off in handcuffs by cops. Those cops and cameras need to be turned around to capture the white wealthy criminals who are thousands of times more larcenous and destructive of the social fabric, yet skate away without jail time, and sometimes not even a fine.
