Is it not clear that seditious Republican maneuvering is the rust that is destroying America's constitutional democracy? All the while, the Democratic Party Defenders are waving law books and watching passively as the nation is corrupted. Where are our constitutional heroes? I certainly count Thom Hartmann as one!

Why are voter rules/regulations set by the States? Since there is so much abuse and voter suppression, and has been for decades (I was in high school when Johnson passed the Voting Rights Act) why can’t it be made federal? Every time they throw things back as a state issue - like they’ve done with abortion - the fraud and damage begins! I read someone’s treatise on Substack that woke me up. The subject was “less government” and attempts to do so, but logically they stated with a land size of 3,532,316 square miles and population of 340,110,988, in reality small government doesn’t work. Also with all the states taking different stands, it’s separating us against each other and no longer a country on common ground. Of course that’s the steps to Civil War and separation.

Thank you William for your comments and thank you so much Daniel for the facts that answered my question - our partisan Supreme Court again! Next question then, is that in would take another voting law act to place it back where it was with explicit laws stopping gerrymandered, suppression and not only against those of color, but the poor and even elderly as well!

I quite agree. I think the constitution gives too much space to states which were absolute fiefdoms when it was written. Many citizens never left the county they were born in, and fewer left the state they were born in. Travel was beyond difficult. But we now need laws that cover the country as many pass through several states quite often.

Kimberley, the problem lies in the very name, The United States of America. States is just another name for a Nation. A parallel is the European Union.

Each of the states in the United States is a sovereign entity, and that is recognized by the Constitution. The federal government only has the powers granted it by the states by a majority vote. The States when they ratified the constitution, and the constitution had to be ratified by the states to have any effect, agreed to abide by all laws that were approved by the majority. To ensure fair play, by the smaller and less populace states, which were in the main, the slave owning agrarian states, but not exclusively NH, VT, RI, CT, were small states, each state would be allotted a representation of two in the House of Lords, err Senate.

Since the House of Representatives (House of Comons) was populated by the rabble of common folk, theHouse of Lords (Senate) would have veto power over them, as all laws had to pass both houses, unlike ratifications of appointments for cabinet and judges, in that case only the approval of the House of Lords was required.

It is famously said that we are a nation of laws and not men, but those laws were written by men. Men pursuring their own self interests, protecting themselves from thing they feared and enabling them to acquire the things that they wanted.

We're supposed to have one (wo)man, one vote. But as my ol Pappy used to say, in electoral matters trees and cows are more important than people.

...and as usual, Democratic “leadership” took a pass.

Despite long and repeated exposure, I continue to be fascinated by the reprehensibility (is this even a word?) of the Republicans from Nixon onward. (A few honorable ones, like Ed Brooke from my state and Mac Mathias from MD, hung on longer, but by the end of the '80s they were nearly all gone.)

Question, though: How reliable was the signature matching when done (mostly, I'm guessing) by amateurs? The more time passes between registration and voting day, the more variation there's likely to be, and age and physical infirmity (including temporary ones like a sprained wrist) can alter one's handwriting. Given the well-documented shenanigans used to prevent voting in Old Dixie, I'm skeptical about the process. In machine-run northern cities, the problem was likely to be the opposite: people voting who weren't eligible.

At 87, my signature hasn't changed much. But I learned to write cursive in the first grade. Now scribbling on a note pad my writing can get messy, but signing something my signature hasn't changed.

Thank you Thom. Hard to believe that I remember all of these GOP outrages. They are heartless racists determined to increase their power as a minority party at any cost and by any means.

Sincerely,

Good links, thanks Daniel.

Am I correct. One has to have legal standing, to bring a case into court (except it seems with the High Unholy Catholic Court formall known as SCOTUS)

If this be true only Kamala can challenge the elections in WI,MI, PA and she rushed to concede while votes were still being counted on 4 pm EST Nov 6th.

I saw Jennifer'a chart as Regards Democratic votes in the above Swing states, a piss poor turnout, yes I accept there was Russian interference, but more importantly three key constituencies , either did not vote or voted for Trump. Muslims, Gen X,Y, Z of the black and Hispanic communities.

To demonstrate their own grievances, they flipped Harris the bird, and thus impaled themselves on the horn of a self created dilemma... Flip the Dems' the bird, or elect Trump.

They chose Trump.

I am old and clearly remember going to the polls and giving my name and having it looked up in a big book. Then I signed something to compare signatures. I still have a driver's license and don't mind pulling it out to vote but have been aware for some time that it is a plan to restrict voting. And Republicans are full of plans to restrict voting.

Thom Hartmann:

I have referenced your 3 articles about Trump

and Covid. They are in a comment to a post on Substack. Heather Cox Richardson wrote the original Substack article.

Here are the three articles I referenced:

https://www.thomhartmann.com/blog/2020/10/was-april-7-day-sealed-fate-america

https://hartmannreport.com/p/covid-this-month-4-years-ago-trump-73b?r=1n30w&utm_campaign=post&utm_medium=web

https://substack.com/home/post/p-152076651?source=queue

Basically I wrote how

555,000 Americans died of Covid during the 12 weeks Trump did nothing (Brookings Institute), and

referenced your articles about Jared reporting to Trump more "black" people and people "of color" were dying of Covid than others, so instead of sending everyone PPE, he chose to do nothing and played golf for 12 weeks, while calling Covid a "hoax."

HCR wrote about Wounded Knee, and pointed out how things might have been different, and that you can't change the past, but you can change the future.

My point was we have time to change the future. It isn't inevitable that Trump will ascend his "throne" as POTUS.

As I pointed out, it would be a disaster.

The DOJ/FBI can stop him. He is a convicted felon.

Congress can stop him.

Article XIV Sec. 3 US CONSTITUTION:

"No person shall...hold any office...who having previously taken an oath...to support the Constitution of the United States, shall have engaged in insurrection...."

President Biden, and Vice President Harris can stop him. They need to stop the "transition" of power because Trump is not qualified to be POTUS.

Will they? I certainly hope so. When people tell you what they are you should believe them.

Trump is distracting everyone with his "picks" for cabinet posts, but really biding his time until he is sworn in and becomes HITLER II.

I have 2 granddaughters that deserve a better world than the hell Trump will provide us with.

Wanted to give you "heads up" that your articles were referenced, and say, "RBG made me do it."😊 Enjoy Australia.

I know the Bush v Gore issue is always the one that gets the most debate. Wasn't Rove the one who said it wasn't about WHO votes but WHO COUNTS the vote?

You stated the media hasn't picked up on....I can't write, with any clarity, about my utter disdain for the media, even the few I thought better of, and their dereliction of duty with purity of malicious intent to omit facts from the public.

This happened in 2016 by the candidate himself, not indicted for an insurrection but of the attempted overthrowing of the majority of voters or DEMOCRACY in 2020 and the plans for 2024 if he didn't win but more so the delay of the information needed to give voters the omitted evidence to make a choice at the ballot box that may have swung the electorate by 25%. Voters should never have been the ones expected to make this decision blindly. Politicians lie and have made scummy deals throughout history but this....this is a felon, adjudicated rapist and a derelict. Screw the SCOTUS for their decision in the 14th for the entire country when states administer their own procedures. No recusals. A legacy of rot for Mr. Roberts' neighborhood thugs and bought off cartel of tyranny.

These three elections I find so intensely disturbing that the one man with immunity, NOW, is more concerned with his legacy and will let enemy(s) of the constitution and government get away with it and somehow Wray and Garland are in the concrete mixer.

What happened to all the migrants we were flying in, paying 4000/day and wining and dining them at 5 star hotels to vote illegally. Mum is the word. Musk is the problem. WTF is he even doing that isn't being contained NOW?

My problem, today, is how the media covers Trump's "Hush Money" trial which was not what the conviction was for. Stemming from the arrangement for catch and kill, the TO CFO going to Rikers, and payments misreported, to two women, funneled through a fixer and the TO CFO to INFLUENCE THE 2016 ELECTION in violation of NY election law and Federal Election Contribution Law. HE WAS CONVICTED OF ELECTION INTERFERENCE no matter how one slices and dices the legalese. Like NY penal definition of RAPE. Way to go ABC, DISNEY, and RM/FOX.

I'd like to know if he is hardly legit as he had no popular vote in 16, Russian help, no mandate, and only was POTUS for 2 years before he tapped out of leadership during the pandemic which may come back around and haunt him again. The virus was here in the fall of 2019 through his departure on Jan 20, 2021. I hope just because he didn't speak of the 1+M Americans he killed, that we don't ever forget as that was never a media topic they wished to cover during the campaign and he certainly didn't speak to it.

I'm disgusted and have disengaged over the holidays but I think of these upcoming years EVERY SINGLE DAY, not for just my own life but everyone.

Arbitors of nothing. Admin of criminals. Destruction for the masses. Compliant sycophants. I feel helpless and wish I could sue fkn someone for the damages I've experienced and will experience but that is only afforded to those who whine about their victimhood and be allowed to live here for two decades, or less, but hates the migrants who don't suit him and need women to produce white babies.

Rant over....

https://en.wikipedia.org/wiki/Kris_Kobach

"Kobach has also said that there are 18,000 non-citizens registered to vote in Kansas, a claim that NBC News described as "misleading" and "debunked".[137]

Kobach supported Trump's claims that millions of non-citizens voted in the 2016 presidential election.[138][139] Kobach estimated that 3.2 million non-citizens voted, citing a widely debunked study.[140] Kobach complained that, during one of his appearances, CNN ran text on the screen saying Kobach's claims that millions illegally voted in the 2016 election were "false".[141] CNN also asked him if he had any proof of his allegation that thousands of Massachusetts voters actually had voted in New Hampshire in 2016. He replied that he had none.[43]"
